Answering all your questions about the Legalities of Getting Married

Can I elope and get married next week?

No one can unless they apply to births deaths and marriages and are exempt from the one month notice. There are only a few reasons why this would be allowed, for example terminal illness, travel or employment commitments. (Please see previous blog)

How long do I have to wait to get married?

You need to sign a notice of intention to marry at least one month to 18 months ahead of the wedding date. Your celebrant can help you complete the form and will be your witness.

What documentation do I need to get married?

You need to have proof of birth and photo ID. If you have a passport that will be sufficient otherwise you will need a birth certificate and photo ID such as a license. If you have been married before you will also need proof of divorce such as a divorce certificate.

Do I have to have a rehearsal?

No, that’s your choice however you will need to sign a document called No legal impediment before the wedding.

What other paperwork do I need to be legally married?

At the wedding you will sign two copies of the official marriage certificate and the decorative certificate of marriage. Your celebrant will have all of these documents ready on the day. You just need to supply two witnesses who are over 18 years old.

How do I get a copy of the official marriage certificate?

You can apply online and the cost is around $50 but your marriage may take 2 to 3 weeks to be registered. Once registered you can go into the birth deaths and marriage department if you would like your certificate faster. Alternatively you can pay for postage and it will be delivered to your house.
